Being Undocumented In This Country Is Not A Crime

On this episode, Yvette and Jehan break down “United States v. Sineneng-Smith,” a case that was up before the Supreme Court this past week for oral arguments regarding a statute that criminalizes encouraging or inducing a migrant to stay in the United States without authorization. 

They outline the reasons the statute at issue is problematically vague and overbroad, how it could potentially be prosecuted, and why it will chill free speech if decided incorrectly.
